Privacy Policy

Proximo Ads LLC ("Próximo Ads," "we," "us," or "our") has prepared this Privacy Policy to explain (1) what personal information we collect, (2) how we use and share it, and (3) the choices and rights you have.

1. Who we are and what this policy covers

Próximo Ads is an advertising agency that helps small businesses with websites, Google Business Profiles, professional email, social media management, graphic design and advertising (the "Services"). This policy applies to personal information we collect through proximoads.com, our client dashboard (the "Portal"), our future mobile app, and our communications with you (together, the "Platform").

Our Services are designed for businesses. When we process personal information on behalf of a client (for example, leads from a client's ad campaigns, messages sent to a client's social media pages, or visitor analytics for a client's website), we act as that client's service provider or "processor." That information ("Customer Personal Data") is governed by our agreement with the client and our Data Processing Addendum, not by this policy.

2. Personal information we collect

Information you give us

  • Contact and inquiry details: your name, business name, email, phone number and anything you write when you use our contact form, email us or message us.
  • Order and account information: name, business name, email, phone, country, state/province, the services you choose and your login credentials for the Portal.
  • Billing information: billing contact and invoice history. Card details are entered directly with our payment processor (Stripe) and are never stored on our servers.
  • Communications: messages you send us through Próximo Chat, Facebook Messenger, WhatsApp, text message (SMS) or email, and notes from calls and meetings.
  • Content for your Services: logos, photos, text, brand materials, account access you grant us (such as admin access to your Google Business Profile, social media pages or ad accounts), and your feedback and approvals.
  • Marketing preferences: whether you have opted in to receive tips and offers from us.

Information we collect automatically

  • Essential technical data: IP address, browser type, device type, language and pages requested, used to deliver and secure the Platform.
  • Cookies and similar technologies: essential cookies always; analytics and marketing cookies only with your consent. See our Cookie Policy.

We do not collect precise geolocation (GPS) data. If a future version of our app ever needs it, we will ask for your permission first.

Information from third parties

  • Platforms you connect: when you authorize it, we receive performance data from Google Analytics, Google Business Profile, Google Ads, Meta (Facebook and Instagram), TikTok, LinkedIn, Pinterest, Reddit, Amazon Ads, X and Metricool to manage your Services and show your results in the Portal.
  • Social media pages: if you interact with our pages on Instagram, Facebook or LinkedIn, that platform's privacy policy applies to its handling of your data, and we receive what the platform shares with page owners.
  • Payment processor: Stripe tells us whether a payment succeeded and the last four digits and brand of your card.

3. How we use personal information

  • To provide the Services and the Portal: set up and manage your website, profiles, email, social media, designs and campaigns; show your billing and analytics; and communicate with you about your account (contract).
  • To bill you: process payments, send invoices and keep tax records (contract and legal obligation).
  • To respond to you: answer questions, quotes and support requests (contract or legitimate interests).
  • To market our Services: send you tips and offers if you opted in, or where the law allows us to contact existing clients. You can unsubscribe anytime (consent or legitimate interests).
  • To improve and secure the Platform: understand how the Platform is used (with consent for analytics cookies), prevent fraud and abuse, and fix problems (legitimate interests).
  • To comply with the law: respond to lawful requests, enforce our Terms of Service and protect our rights (legal obligation and legitimate interests).

We may create de-identified or aggregated data (for example, average cost per lead across clients) that does not identify you or any individual, and use it to improve our Services.

4. How we share personal information

  • Service providers (subprocessors) that host, secure and operate the Platform and help us deliver the Services, such as hosting, payments, email, analytics and customer support tools. See our current list of subprocessors.
  • Platforms you ask us to use for you: when we publish your website, manage your profiles or run your ads, we share the content and settings needed with those platforms (such as Google, Meta or TikTok). Their own terms and privacy policies apply.
  • Authorities and others when we believe in good faith it is required by law or needed to protect rights, safety or property.
  • Business transfers: in connection with a merger, acquisition, financing or sale of assets, subject to this policy.

We do not sell personal information for money. If you accept marketing cookies, some advertising partners may receive information about your visit, which certain U.S. state laws call "sharing" for targeted advertising. You can opt out anytime in Cookie settings (footer), and we honor Global Privacy Control signals automatically.

5. Google API Services data

When you connect Google services (such as Google Analytics, Google Business Profile, Google Ads or Google Search Console) to Próximo Ads, you authorize us to access the data for the accounts and properties you select, such as traffic, sessions, page views, clicks, impressions, calls, reviews, campaign spend and conversions.

We use this Google user data only to provide and improve user-facing features of the Services: managing your Google presence and campaigns, and showing analytics and reports in your Portal. We store it only as long as needed for those features, as described in Section 9.

Próximo Ads does not sell Google user data, does not use it for advertising or retargeting, does not use it to determine creditworthiness or for lending, does not transfer it to data brokers, and does not use it to train generalized AI or machine-learning models. We only transfer it to subprocessors needed to provide the Services, when you direct us to, or when required by law. Our use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

You can revoke our access anytime from your Google Account settings or by asking us.

6. Text messages and WhatsApp

If you message us by SMS or WhatsApp, or give us your number and agree to receive messages, we use your number to reply and to send account and service updates. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of text messages or HELP for help. We do not share or sell mobile numbers or text-messaging consent with third parties for their marketing purposes.

7. Your choices and rights

Depending on where you live (for example, the European Union, the United Kingdom, or U.S. states such as California, Colorado, Connecticut, Virginia or Texas), you may have the right to:

  • know what personal information we hold about you and get a copy;
  • correct inaccurate information;
  • delete your information;
  • restrict or object to how we use it, including for direct marketing;
  • receive your information in a portable format;
  • withdraw consent at any time (this does not affect earlier processing);
  • opt out of "sales," "sharing" or targeted advertising; and
  • appeal our decision on your request.

To make a request, email hello@proximoads.com. We may need to verify your identity before responding, and you may use an authorized agent where the law allows. We will not discriminate against you for exercising your rights. If we deny your request, we will explain why and how to appeal. You can unsubscribe from marketing emails using the link in any email.

If you are in the EU or UK, you can also complain to your local data protection authority (in Spain, the Agencia Española de Protección de Datos).

8. International transfers

We are based in the United States, and our service providers may process data in the United States, the European Union and other countries. When we transfer personal information from the EU, UK or Switzerland, we rely on adequacy decisions (such as the EU-U.S. Data Privacy Framework, where the recipient is certified) or the European Commission's Standard Contractual Clauses.

9. How long we keep information

We keep personal information only as long as needed for the purposes above:

  • Inquiries from people who don't become clients: up to 24 months after our last contact.
  • Client account, order and billing records: for the life of the relationship, then for as long as tax and accounting laws require (generally 7 years).
  • Customer Personal Data we process for clients: deleted within 90 days after the client relationship ends, as described in our DPA.
  • Analytics data: according to the retention setting of the analytics tool (for example, 14 months in Google Analytics).

10. Security

We use reasonable administrative, technical and organizational safeguards, including encryption in transit (HTTPS), multi-factor authentication on our business accounts, role-based access controls so each client sees only their own data in the Portal, and reputable hosting providers. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a security incident affects your information, we will notify you as required by law.

11. Children

The Platform is not intended for anyone under 18, and we do not knowingly collect personal information from children. If you believe a child has given us personal information, contact us and we will delete it.

12. Other websites and services

The Platform links to third-party websites and apps (such as social networks and ad platforms) that we do not control. Their privacy policies apply to your use of them.

13. Changes to this policy

We may update this policy from time to time. If we make material changes, we will update the date above and notify you through the Platform or by email. Changes take effect when posted unless we say otherwise.
